Dear Mr. Nagler

Thank you for your letter in which you draw attention to the right wing extremist activities of Mr. Irving.[¹]

You may rest assured that the Office for the Protection of the Constitution observes very carefully every attempt at manifestations of his activity in the Federal Republic. This Office contributes to preventing such activities within the framework of our judicial possibilities and it helps in the enlightenment of the public regarding the true aims of political extremists.

I share your concern about the dangers which can result from extreme right wing propaganda, but I have grounds for firm belief that such propaganda, in view of the German experience with National Socialism cannot have any lasting effect.

The Federal Minister of the Interior had already instructed the frontier control authorities in March 1990 to send back Irving when attempting to enter the Federal Republic. In practice, however, this can only be done in an imperfect manner, since the frontiers between EC countries are wide open.

1. The Bundesamt f¸r Verfassungsschutz, Germany’s MI5-type organisation, has been involved in the sleaziest of scandals since its inception, from the very start when its chief Dr Otto John, a “hero of the resistance,” turned out to be a Soviet double-agent. Its annual reports at both Federal and Provincial (Land) level are riddled with lies and inaccuracies, which the BfV refuse to correct. In fact they do not even acknowledge letters pointing out the errors, which they are quite happy to allow to stand. Being a Government agency, they are above the law in Germany.

   EVERY subject now has the statutory right under the Data Protection Act, 1984, to give the Board of Deputies forty days’ notice in writing to provide copies of all data maintained by the Board on them, and to require the Board to make such corrections as the subject concerned may require.
   Subjects who suspect that they are being victimised should write in the first instance by Recorded Mail to the Research Unit, Board of Deputies of British Jews, marking their letter for the attention of Michael Whine, Director, Research Unit, Commonwealth House, 1 – 19 New Oxford Street, London WC1A 1NF.
   If the Board refuses to give satisfaction within forty days, the subject should then complain in writing to the Registrar of the Data Protection Agency, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF; the agency has statutory powers to search and seize databases in the event of non compliance with the Act.
